Barry & Loewy LLP has secured a $565,000.00 settlement for an Austin man seriously injured in a motorcycle accident. The man was permanently injured after being struck by an automobile that made a dangerous left turn and slammed into the motorcycle. The Austin man sustained permanent injuries to his hip and back.
As a direct result of Barry & Loewy LLP’s litigation strategy, the case settled in substantial excess of the automobile driver’s insurance policy. The case was also settled without filing a lawsuit. The net recovery to the Austin man is $371,000.

Barry & Loewy LLP has settled a legal malpractice and fraud lawsuit on behalf of a Bay City man who was defrauded by a Texas lawyer. The lawyer gave patently false legal advice to our client in an attempt to swindle him out of his money he was owed on a real estate deal. After intense negotiations, the case was settled for $210,000, with a net recovery to the Bay City man of $118,000.

Truck Accident Lawsuit for San Antonio Family
Barry & Loewy LLP has settled a truck accident
lawsuit for a San Antonio family. The family was
seriously injured when an 18-wheeler driving
northbound on IH-35 lost control, flew over the
median, and slammed into the family as they were
going southbound.
The defendant truck company initially offered
$250,000 to settle the case but as a direct result
of Barry & Loewy LLP’s litigation efforts, the truck
company agreed to settle the case for $435,000. The
medical bills in the case totaled less than $30,000,
so the final settlement was almost 15 times higher
than the medical bills. Final disbursement to
clients is pending.

Trucking Accident Wrongful Death Case in Austin
Barry & Loewy LLP has settled a wrongful death
case involving an 18-wheeler tractor trailer that
ran over and killed a 71-year-old man who was
crossing an intersection in Austin, Texas.
The man was crossing the intersection at Ben White Boulevard and the outer road of IH-35. The driver of the 18-wheeler tractor missed the curved turnoff and pulled up to the intersection. He then made a very dangerous right hand turn and clipped the man as he was walking across the street. The truck’s back tires ran over and killed the man. The case was complicated by eyewitness testimony stating that the 71-year-old was not paying attention and that he allegedly walked into the truck.
Lead counsel, Carl R. Barry, settled the case for a confidential amount days before it was set to go to trial. The settlement is believed to be one of the largest contributory negligence truck-pedestrian wrongful death settlement in Austin in the past ten (10) years.

Lawsuit in San Angelo, TX
Barry & Loewy LLP has settled a civil rights
violations lawsuit involving police brutality in San
Angelo, TX.
The case involved a man who was arrested by San Angelo police and taken to the Tom Green County Jail. While at the jail, the police officers laid the handcuffed man on the ground and then repeatedly kicked and beat the man with a police baton. The beating was so brutal that is caused the man’s colon to perforate and he was forced to defecate into a colostomy bag for four (4) months.
This was a very challenging lawsuit because the police officers denied beating the man. Lead counsel, Adam Loewy, had to rely solely on circumstantial evidence to force the City of San Angelo to the negotiating table. After lengthy and high pressure negotiations, the case was settled for a confidential amount.

Wrongful Imprisonment Suit for $5 Million Dollars
Barry & Loewy LLP has settled a wrongful imprisonment
lawsuit against the City of Chicago for $5 Million
Dollars on behalf of Aaron Patterson.
Mr. Patterson was wrongfully imprisoned on Illinois Death Row for 15 years for a double murder he did not commit. Police officers lead by the infamous Lt. Jon Burge had brutally beaten a false confession out of Mr. Patterson. In 2003, Illinois Governor George Ryan formally pardoned Mr. Patterson on the basis of actual innocence.
Lead counsel, Carl R. Barry, settled Mr. Patterson’s case with the City of Chicago for $5 Million Dollars. Mr. Patterson expected to receive $3 million from city case pending court approval.

Barry & Loewy LLP settled a Multi-Million Dollar breach
of contract lawsuit on behalf of its client, TELLIS
Software, a small San Antonio, TX software company.
In 2005, TELLIS signed a Multi-Million Dollar contract with PokerTek, Inc. (NASDAQ: PTEK) to develop software for its electronic poker tables. TELLIS developed the software but PokerTek, Inc. maliciously breached the contract in order to avoid paying TELLIS.
Barry & Loewy LLP filed suit against PokerTek, Inc. for breach of contract and fraud. The case was settled for a confidential amount.

Barry & Loewy LLP Wins $262,500.00 Verdict in New
Braunfels, Texas
On October 26, 2007, after a 5-day jury trial, Barry &
Loewy LLP won a $262,500.00 verdict for its client, Randy
Patton, in the 207th Judicial District Court of Comal
County, Texas.
Mr. Patton had entered an employment compensation agreement whereby he would be awarded 5% of the gross sales price of a golf course when it sold in exchange for managing the golf course, and other duties. The golf course owner, Dar-Sheng Chen, and his lawyer, Diego Lopez, concocted a plan to deny Mr. Patton his 5% compensation and disgracefully cancelled the agreement right before the golf course sold. Thereafter, they refused to pay Mr. Patton the money he was owed.
The jury found the golf course owner and his lawyer (in his corporate representative capacity) liable for breach of contract and fraud, and ordered them to pay Mr. Patton $262,500.00. The jury also found against the Defendants on all of their counterclaims.
Comal County is one of the most conservative counties in Central Texas and this is believed to be the largest verdict in recent memory in the county. Disbursement of funds will take pending resolution of appeal.

Monthly Magazine
Austin Monthly Magazine is a very popular magazine that
has been published since 1993. In early 2006, a rival
publisher started “Austin Magazine.” This new magazine was
designed to look substantially similar to Austin Monthly
Magazine. The publishers of “Austin Magazine” designed their
magazine in this way in an attempt to confuse the public and
carve in Austin Monthly’s readership base.
The owners of Austin Monthly Magazine hired Barry & Loewy LLP to bring suit against Austin Magazine on the grounds of trademark infringement, unfair competition and tortuous interference.
As a direct result of Barry & Loewy LLP’s litigation tactics, the publishers of ‘Austin Magazine’ decided to shut down the magazine and close their business. This was a total victory for Austin Monthly Magazine. The lawsuit put a rival magazine out of business.
