  • Barry & Loewy LLP represents an 8-year-old Austin girl who sustained serious injuries in a wrecking yard accident. The girl was under the supervision of a family acquaintance, who owns and operates a wrecking yard. The man failed to properly supervise the 8-year-old. A piece of wrecking equipment fell on the 8-year-old and she suffered a broken femur and related serious injuries. The injuries are so severe that doctors are concerned she may not ever walk correctly again. The suit is pending in the 126th Judicial District of Travis County, Texas.
  • Barry & Loewy LLP represents the family of Kevin Brown, an Austin man killed by Sgt. Michael Olsen in June 2007. The family has filed a federal lawsuit alleging that Sgt. Olsen violated Kevin Brown’s civil rights when he shot him twice in the back and killed him. The lawsuit is pending in the Western District of Texas, Austin Division.   • Barry & Loewy LLP is representing a Texas software developer in a breach of contract and fraud action against PokerTek, Inc (NASDAQ: PTEK). The lawsuit alleges that PokerTek induced the developer to create software for its business and then maliciously breached the contract in order to avoid paying the developer. Barry & Loewy LLP is seeking millions of dollars in actual and exemplary damages.
  • Barry & Loewy LLP represent the family of an Austin man who was killed by a large commercial truck while walking his bicycle across the street. The 18-wheeler struck the pedestrian as he was walking his bicycle in the crosswalk with the right of way. The man was pronounced dead at the scene by the Austin Police Department. The trucking company has been involved in numerous other accidents (some involving fatalities) over the past year. Barry & Loewy LLP is seeking millions of dollars in compensatory and punitive damages for the family of the deceased Austin man. The case is set for trial in February 2008 in the District Court of the Western District of Texas, Austin Division.

June

  • Barry & Loewy LLP represents a San Antonio man and his young son who were seriously injured in a truck accident on IH-35. The truck driver was speeding northbound on IH-35 when he negligently lost control of his truck and went over the guardrail into southbound traffic. The truck slammed head-on into the man’s vehicle. The man and his young son sustained serious personal injuries. The accident also tragically killed a 19-year-old San Antonio woman.

  • Barry & Loewy LLP represent the family of a Texas industrial worker who wrongfully died of complications directly arising from his Severe Asbestosis. Shortly before his death, the Texas man was on permanent oxygen and confined to a wheelchair because his impairment was so severe he was unable to walk or exert himself. Sadly, the Texas man died because his Severe Asbestosis impairment kept him from getting enough oxygen into his bloodstream. The Texas man developed his Severe Asbestosis disease after many years of exposure to asbestos-containing products during his work as a laborer in a Houston-based industrial facility. Barry & Loewy LLP is co-counseling the case with the Austin firm of Mundy & Singley LLP.s
  • Barry & Loewy LLP represents an Austin man who was seriously injured when he was run off the road by a large commercial truck (18-wheeler). The Austin man's car was slammed into, run off the road and subsequently rolled over as the the 18-wheeler hit the Austin man's car when it merged directly into the Austin man's lane. The truck driver fled the scene of the accident but was later apprehended by the Austin Police Department. The truck driver was ticketed for causing the accident. The impact of the crash destroyed the Austin man's vehicle and caused him to sustain serious personal injuries.

April

  • Barry & Loewy LLP represent a Houston mother and her two young children who were all seriously injured when a large commercial truck (18-wheeler) driving at a high rate of speed rear-ended the mother and her children who were stopped at a stop light. The crash occurred outside of Houston. The impact of the crash totaled the family’s vehicle and caused a four car pileup. The commercial truck driver was ticketed for causing the accident. The family was rushed to the Emergency Room for emergency medical care and evaluation.

  • Barry & Loewy LLP represent a British Petroleum (“BP”) Refinery worker who sustained serious injuries as a result of the Texas City BP Refinery Explosion of March 23, 2005. The BP Explosion was one of the most deadly and costly refinery explosions in history. Hundreds of people were injured and killed in an explosion which shattered windows within a half-mile of the refinery and was heard five miles away. Barry & Loewy LLP is seeking an unspecified amount in actual and exemplary damages for BP’s negligent and grossly negligent conduct which lead to the explosion.

  • Barry & Loewy LLP is representing Aaron Patterson, a Chicago man who was wrongfully imprisoned on Illinois Death Row for 15 years. Mr. Patterson was formally pardoned on the basis of actual innocence in 2003 by the Governor of Illinois. The case is titled Aaron Patterson v. Former Chicago Police Lt. Jon Burge et al. and is filed in the Eastern Division of the Northern District of Illinois. Barry & Loewy LLP is seeking tens of millions of dollars in actual and exemplary damages. Barry & Loewy LLP is co-counseling this case with Avila Tomic LLC of Chicago.
  • Barry & Loewy LLP is representing four families whose minor daughters were sexually assaulted by adult MySpace.com members. The assaults occurred in Ohio, South Carolina, New York, and Texas, respectively. In each case, an adult MySpace.com member contacted the minor girl, obtained her personal information, and later sexually assaulted her. Barry & Loewy LLP is suing MySpace.com for its negligent and fraudulent conduct. The cases are filed in California state court. Barry & Loewy LLP is co-counseling these cases with Arnold & Itkin LLP of Houston.
